A testamentary trust is unique because it’s created through your will and only comes into effect after you pass away. Unlike living trusts, which avoid probate, a testamentary trust goes through the probate process. This can be advantageous in certain situations, particularly when you have minor children or beneficiaries who may need ongoing financial support or guidance.
Consequently, a testamentary trust allows you to specify exactly how and when your assets are distributed to your beneficiaries. You can set age restrictions, dictate how the funds should be used (education, healthcare, etc.), and even appoint a trustee to manage the assets responsibly.
Moreover, testamentary trusts offer an extra layer of protection for beneficiaries who might not be financially responsible or capable of managing a large sum of money. The appointed trustee ensures that the assets are used according to your wishes, safeguarding the beneficiary’s well-being.
