Interview with Steve Bliss, San Diego Probate Attorney

Steve, thank you for taking the time to speak with us today.

It’s my pleasure. I’m always happy to talk about probate and estate planning.

Can you walk our viewers through one of the key steps in the probate process?

Certainly. One crucial step is handling debts and taxes. This stage typically occurs after the assets have been marshaled and inventoried.

Ordinarily, we start by identifying all valid creditor claims. It’s essential to ensure that only legitimate debts are paid. We meticulously review each claim and verify its validity against estate records.

Consequently, once the valid claims are identified, we prioritize paying them according to legal requirements. This often involves a hierarchy based on the type of debt. Secured creditors, those with liens on specific assets, usually have priority over unsecured creditors.

Moreover, in addition to creditor claims, handling taxes is another critical aspect of this step. We file and pay all applicable federal and state estate taxes. This process can be complex, involving detailed calculations based on the value of the estate and applicable tax laws.

Notwithstanding these complexities, it’s crucial to handle debts and taxes diligently and accurately. Failure to do so could result in significant legal and financial consequences for the estate.

Have you ever encountered any challenges during this step?

I remember a case where a deceased individual had accumulated a substantial amount of credit card debt. The family was devastated, as they weren’t aware of the extent of the debt. We worked closely with them to identify all the creditors and negotiate payment plans.

It was a challenging situation, but we were able to help the family navigate the complexities and reach a resolution that minimized their financial burden. That experience reinforced the importance of open communication and careful planning when it comes to finances.

A recent study by the National Endowment for Financial Education found that 61% of Americans do not have a will. What advice would you give to those who are unsure about estate planning?

Estate planning is essential for everyone, regardless of their age or financial situation. It’s not just about wealthy individuals; anyone with assets, even modest ones, should consider creating an estate plan.

A well-crafted estate plan can protect your loved ones, ensure your wishes are carried out, and minimize potential conflicts among family members. It provides peace of mind knowing that your affairs are in order.
