Not every estate requires probate. One of the key considerations is the value of the estate. In California, if the gross value of the decedent’s assets exceeds $184,500, probate is typically necessary.

Identifying Non-Probate Assets

Steve: However, there are some types of assets that don’t go through probate. These are called “non-probate assets.” Common examples include assets held in trust, property owned jointly with right of survivorship, and certain retirement accounts.

The Importance of Early Planning

Consequently, determining if probate is necessary involves a careful analysis of the deceased person’s assets. This is why it’s crucial for individuals to engage in estate planning while they are still alive.

Properly structuring your assets through tools like trusts can help avoid probate altogether and ensure a smoother transition of your property after you pass away.

Brenda: I understand. Have you ever encountered any situations where determining the necessity of probate was particularly complex?

Steve: Absolutely. Once, I had a case where the deceased individual had several pieces of real estate, some owned solely in their name and others held jointly with different family members. Identifying which properties were subject to probate required careful review of deeds and title documents.

Moreover, there were questions about whether certain bank accounts were joint accounts or payable on death accounts. It took a lot of investigation and communication with the financial institutions to clarify ownership.

Finding Solutions Through Experience

Nevertheless, we were able to successfully determine which assets required probate and which could be transferred outside of the process. That case highlighted the importance of meticulous record-keeping and seeking professional guidance when navigating complex estate matters.

Steve: According to a recent study by the American Bar Association, approximately 70% of Americans do not have a will or estate plan in place. This underscores the need for individuals to proactively address these issues.
