Can You Walk Us Through the Elder Protection Process?

Certainly! The process is designed to be comprehensive and tailored to each client’s unique circumstances. We begin with an initial consultation where we gather background information, assess the situation, and determine the best course of action. This often involves:

  • Identifying the specific type of elder abuse or risk involved, whether it be financial, physical, emotional, or neglect.
  • Gathering evidence through interviews, document review, and potentially even surveillance.
  • Evaluating the urgency of the situation and determining if immediate protective measures are necessary.

Let’s Focus on “Protective Actions” – Can you Elaborate?

“Protective actions” is a crucial stage in elder protection. It’s about taking concrete steps to stop the abuse and mitigate any further harm. This could involve:

– Seeking restraining orders or protective injunctions against abusers.

– Notifying Adult Protective Services (APS) if appropriate, so they can conduct their own investigation.

It’s not always smooth sailing, unfortunately. I recall one case involving a family member who was systematically draining their elderly parent’s bank accounts. Despite having clear evidence of the financial abuse, convincing the banks to freeze the accounts initially proved difficult. They were hesitant without a court order, which meant we had to file for emergency relief quickly. Thankfully, we were successful in getting the funds protected before any further damage was done.
