If less restrictive alternatives like a power of attorney aren’t suitable, then we move forward with filing a petition with the court.”

They conduct interviews with the proposed ward, their family members, and caregivers to get a comprehensive understanding of the situation. Medical evaluations are often ordered to assess decision-making capacity. The investigator then prepares a report for the judge, outlining their findings and recommendations.”

Courts typically require that less restrictive alternatives—such as powers of attorney, supported decision-making arrangements, or advance directives—be thoroughly explored and deemed ineffective or unavailable before appointing a guardian or conservator.
