Can you walk us through the different types of conservatorships?
Absolutely. Conservatorships are tailored to specific needs. There’s Conservatorship of the Person, which focuses on personal care decisions like housing and healthcare. Then we have Conservatorship of the Estate, which handles finances and assets. For individuals with developmental disabilities, there’s Limited Conservatorship, granting specific powers. Temporary Conservatorships provide immediate help in urgent situations, while LPS Conservatorships address serious mental health needs.
Let’s dive into step ‘B: Establishing a Conservatorship’. Can you tell us more about that process?
Establishing a conservatorship involves several key steps. First, someone – often a family member or concerned individual – files a petition with the probate court. It’s crucial to notify the proposed conservatee and relevant family members. The court then appoints an investigator or social worker who conducts an independent assessment of the situation. A medical or psychological evaluation is also required to determine the individual’s capacity.
Finally, there’s a hearing where the judge reviews all the information presented – the petition, the investigation report, and any other relevant evidence – and makes a decision about whether to grant the conservatorship.
