Steve, many people find the estate planning process daunting. Where do you recommend clients start?
“I always advise my clients to begin by carefully considering who they will choose as their executor,” Steve explains. “This individual will be responsible for carrying out the wishes outlined in your will or trust after you’re gone. It’s a significant responsibility, requiring someone trustworthy, organized, and capable of handling financial matters.”
He emphasizes the importance of open communication: “It’s essential to discuss your expectations with potential executors beforehand. Explain your reasons for choosing them and outline the tasks they will be expected to perform. This transparency helps ensure a smooth transition and minimizes the potential for conflicts later on.
Consequently, selecting an executor who possesses strong organizational skills is crucial. They’ll need to gather assets, pay debts, file tax returns, and distribute remaining property according to your wishes. It’s a complex process that requires attention to detail and a willingness to navigate legal requirements.”
Moreover, Steve cautions against automatically choosing the oldest child or closest relative. “While familial ties are important, they don’t always guarantee competency in this role,” he says. “Sometimes, a trusted friend or professional advisor might be a better fit.”
One client I worked with initially wanted to name their eldest son as executor. However, upon reflection, they realized he struggled with managing his own finances and felt overwhelmed by responsibility. Ultimately, they chose a close family friend who had a background in accounting, ensuring a more capable and organized handling of their estate.
