It’s important to remember that this person will be dealing with sensitive matters, including distributing assets to beneficiaries and potentially making decisions about your final arrangements. Moreover, they’ll need to navigate legal complexities and paperwork. I often advise my clients to have open conversations with the person they are considering appointing, ensuring they understand the responsibilities involved.
While many individuals choose a family member, some opt for a professional trustee, particularly if their estate is complex or there are potential family conflicts. Notwithstanding this choice, clear communication and mutual understanding between the individual making the will or trust and the chosen executor or trustee are paramount.

Yes, there have been instances where families disagreed on who should be the executor. I recall one case where siblings had differing opinions about which of them was best suited for the role. This led to a lot of tension and ultimately required mediation to reach a solution.
It underscored the importance of having open family discussions about estate planning well in advance. In that particular case, if the parents had clearly communicated their wishes and perhaps even involved all the children in the decision-making process, it might have prevented some of the conflict.
